Terms of Service

These terms govern the use of the Popsie application. By creating an account you accept them. If you disagree, do not use the app.

1. Who operates Popsie

Popsie is built and operated by Mattia Stangherlin, a natural person.

Single point of contact under Articles 11 and 12 of Regulation (EU) 2022/2065 (Digital Services Act), for both users and authorities: hello@popsieapp.com. Communication languages are Italian and English.

Popsie is distributed free of charge and is not, at present, a commercial activity: the developer is declared as a non-trader on the app stores. Certain protections applicable to contracts with traders may therefore not apply.

2. What Popsie is

Popsie is an app for tracking movies and TV shows, discovering new ones, organising them into lists and sharing them with other people. Title information comes from external sources (see Legal notices & credits).

Popsie does not stream, host or enable the streaming of any movie or show. It only indicates which platforms carry a given title. Watching it requires a subscription to the relevant platform.

It stays yours. By posting it you grant the developer a free, non-exclusive licence limited to displaying, storing and transmitting it to other users to the extent needed to operate the app. The licence ends when you delete the content or your account: deleting your account also removes the conversations you took part in, including the copies in recipients' inboxes.

You are responsible for what you post. You warrant that you have the right to post it and that it infringes nobody's rights.

5. Rules of conduct

These are the rules we apply to content posted on Popsie - message text, usernames, list names and descriptions, recommendation notes. They are the moderation terms required by Article 14 of the Digital Services Act.

6. Reports and moderation

Any user can report content or a profile directly in the app, using the Report action available on profiles, messages, recommendations and lists. Alternatively, or if you have no account, write to hello@popsieapp.com stating precisely what the content is, where it is, and why you consider it illegal or contrary to these rules. This is the notice and action mechanism required by Article 16 of the Digital Services Act.

Depending on severity: removal of the content, restriction of its visibility, a warning, temporary suspension, or permanent closure of the account. Accounts repeatedly used to post manifestly illegal content are suspended.

Challenging a decision

If you believe a removal or suspension is wrong, you may challenge it within 6 months by writing to hello@popsieapp.com. We will reconsider the case and reply with reasons. Your right to turn to an out-of-court dispute settlement body or to a court is unaffected.

Popsie is run by a single individual and qualifies as a microenterprise: it is therefore exempt from the obligations of Section 3 of Chapter III of the Digital Services Act (periodic transparency reports, a formalised internal complaint-handling system, trusted flaggers). The obligations described above are nonetheless applied voluntarily beyond what is strictly required.

7. Blocking other users

You can block another user at any time from their profile. A block stops both sides from messaging each other and hides your content from the blocked person. Blocked profiles are listed under Settings → Account → Blocked users.

8. AI chat

AI chat suggestions are generated by an artificial intelligence system. They may be inaccurate, incomplete or out of date: treat them as starting points, not as verified information. They are not advice of any kind.

AI chat use is subject to a daily message limit, which may change. Using it to generate illegal or offensive content, or to attempt to bypass its limits, is prohibited. Processing of chat data is described in the Privacy Policy.

9. Service availability

Popsie is provided "as is", free of charge and without any guarantee of uninterrupted operation. The service may be suspended, changed or discontinued, including permanently. In the event of permanent discontinuation we will give reasonable notice where possible, so you can export or save your data.

Title information, including streaming availability, comes from external sources and may be incomplete or out of date.

10. Liability

To the extent permitted by law, the developer is not liable for indirect damages arising from use of, or inability to use, the app, nor for content posted by users, nor for the unavailability of third-party services.

Nothing in these terms limits liability for wilful misconduct or gross negligence, nor your mandatory rights as a consumer.

11. Closing your account

You can delete your account at any time under Settings → Account → Delete account. See the Account deletion page for what exactly is removed.

We may suspend or close an account that repeatedly or seriously breaks these rules, stating the reasons unless prohibited by law.

12. Changes to these terms

These terms may change. Material changes will be announced in the app with reasonable notice. Continuing to use Popsie after they take effect means you accept them; otherwise you can delete your account.

13. Governing law and jurisdiction

Italian law applies. If you act as a consumer, the courts of your place of residence or domicile remain competent, and the mandatory provisions of your EU country of residence continue to apply.
